In many construction projects, an architect and an owner enter into a contract regarding the design, construction and construction management of a complex, facility or residential property.
It is important to know that as sometimes things can go wrong, and do – a failed design, an injury of another, a late performance of contract terms, this contract includes a diligence of standard of care that may extend to other parties.
In the case where a third party is injured at such a facility or residence, the injured party may assert that the architect in charge of design and construction was negligent in the performance of services even though the injured third party was not party to the design and construction contract. As described by the Black+Vernooy Architects vs. Smith case from December of 2010, the A/E (architect/engineer) has the duty, “after having contractually agreed to ‘endeavor to guard’ against defects and deficiencies, to notify the owner of open, obvious, and observable defects implicating critical safety and structural integrity concerns” [and this duty] “extends to third-party visitors who are ultimately injured.”
In this matter the court found that the architect/engineer duty to use due care in fulfilling contractual duties extended to persons foreseeably subjected to the risk of personal injury.”
